APP Service Terms

We are grateful for your choice to register with us. Prior to your registration and any subsequent use of our services provided through the APP, you need to read carefully the Service Terms that defines rights and obligations for both sides during your use of our services.If you disagree with any portion of the Service Terms, you should stop using the Services immediately. Any continuation of you using the services implies that you agree with the Service Terms in its totality.
You are entering this Service Terms with Shenzhen Times Ark Technology Innovation Co., Ltd (hereinafter referred to as “us”, “we” or “Company”), a company incorporated under the laws of China having its registered address located at 4th Floor, Building C, Mingxin Industrial Park, Hualong North Road, Longhua New District, Shenzhen, Guangdong, China.
Service Scope
Once you become one of our registered users, you will be able to use the following services via the APP:
(a) You will be able to have Bluetooth connection between the APP and the product you purchased with us or any of our authorized dealers (“Product”).
(b) You will be able to use the relevant functions as identified on the APP to remote control the Product, including but not limited to control and adjust the volume.
(c) You will be able to provide any advices or comments in connection with the using of the APP and/or Product.
We reserve the rights to expand or limit the service scope available on the APP at any time without your prior consent nor any prior written notification. Any variation of service scope shall become effective immediately when it is completed and made available online.
We don’t sell products for purchase by children. Children should not submit any personal Information to us.
Your Rights and Obligations
(a) You have the right to use the APP or services made available on it without being subject to any extra charges.
(b) You have the right to complaint and feedback any irregularities you encounter during your use of this APP.
(c) You are entitled to exercise any of your rights defined under the APP Privacy Policy
(d) You have the right to cancel and delete the APP and stop using the services provided by us any time at your discretion.
(e) You will not be allowed to let any other one use your account and if we detect your account is being requested to login on another device we may add another level of authentication by sending you email or text message for confirmation.
(f) You will take full responsibility for your use of the services on the APP and therefore we remind you to read carefully the Product instruction/manual for proper using of the services.
(g) When you are posing any comments or queries with respect to any of the services you use, we appreciate that you will act responsibly by providing comments and raise queries independently and honestly. If we deem the language you use or the way you express your opinions do not conform to that standard or may even violate any applicable laws, we may suspend you for continuing using the services until any adverse impact has been eliminated.
Intellectual Properties
(a) You understand that we own any and all intellectual properties in association with the APP or the Products, including not limited to, copyrights of the source code, graphic design and images of the APP, as well as any other technologies developed by us enabling you to use the services via the APP. You will be refrained from reversing engineering the APP and/or using any of the images and/or design components without prior permission from us.
(b) You commit to immediately notify us of any infringing activities against our IP rights by third parties and to further assist us in making claims against infringers.
Disclaimer
(A) YOU UNDERSTAND AND AGREE THAT AVAILABILITY OF ANY PARTICULAR SERVICE ON THE APP MIGHT NOT BE GUARANTEED AND BLUETOOTH CONNECTION BETWEEN APP AND THE PRODUCT MIGHT NOT BE AVAILABLE. YOU WILL NOT HOLD US LIABLE FOR ANY LOSS OR DAMAGES DUE TO INAVAILABILITY OF ANY SERVICE ON THE APP.
(B) YOU ALSO UNDERTAND AND AGREE THAT ANY OF THE SERVICES ON THE APP ARE PROVIDE ON “AS IS” BASIS AND WE DO NOT GUARATNEE THAT THE SERIVCE WILL FUNCTION 100% ACCURATELY AND IT IS NORMAL THAT UNDER CERTAIN CONDITION SERVICE MAY NOT FUCTION PROPERLY.
(C) WE DO NOT WARRANT THAT THE APP OR CONNECTION BETWEEN THE APP AND THE PRODUCT VIA YOUR DEVICE SHALL BE FREE FROM BEING AFFECTED BY VIRUS OR MALWARES. WE WILL IMMEDIATELY STOP PROVIDING YOU SERVICE UPON DETECTING ANY OF THIS AND WILL NOT BE HELD LIABLE FOR DOING SO.
(D) SERVICE PROVIDE VIA THE APP IS NOT REGARDED AS MEDICAL SERVICE AND SHALL NOT REPLACE HEALTH PROFESSIONAL ADVICE.
Applicable Laws and Dispute Resolution
This Service Terms shall be governed and construed in accordance with the laws of People’s Republic of China. Dispute or controversy arising out of or in connection with this Service Terms shall be amicably settled by both of us, failing which, either party may submit to arbitration to be administered by the Shenzhen Court of International Arbitration (“SCIA”) pursuant to its then-current arbitration rules. Any arbitration proceeding shall be conducted in English. Seat shall be in Shenzhen. Arbitration Tribunal shall consist of sole arbitrator.
